Providing Experienced Mediation And ADR Counsel
It is not uncommon for divorcing parties to expect litigation and prepare for trial. But this is a common misconception. While some contested cases may very well go to litigation, the majority of cases are now settled through mediation and other alternative dispute resolution (ADR) mediums such as negotiation and arbitration.
Mediation is the most commonly used type of ADR when it comes to resolving divorce and other family law issues. It can also be used for other types of conflicts, including civil litigation, personal injury and juvenile/domestic violence matters.
At McMahan Perry & Phillips, LLC, our mediator, Kierston M. Phillips, is licensed and certified through the Georgia Commission on Dispute Resolution. Our attorneys have broad experience for family law matters that are both mediated and litigated.
We utilize our vast mediation skills and knowledge to help address our clients’ concerns and seek the best outcome for their specific situation. Whether you require family law mediation, divorce mediation or mediation in other areas of the law, we can help.
What Is Mediation?
Mediation is when a neutral third party (the mediator) resolves a dispute. The mediator facilitates communication and negotiations between the parties. Unlike a judge, a mediator does not force either party into an agreement. Rather, it is completely up to the parties to come up with an agreement customized to their specific needs.
Everything is strictly confidential in a mediation. There is also the protection against bringing in third parties, such as witnesses. The main goal of mediation is to come up with an amicable resolution that satisfies both parties without the stresses of litigation.
What Are The Benefits Of Mediation?
There are many benefits to utilizing mediation over litigation, including:
- Cost: For the most part, mediation is much less costly than litigation.
- Efficiency: An entire divorce agreement can be figured out through mediation, which often only takes a few weeks. Litigation can often drag out for months or even years.
- Resolve your differences: Judges do not really want to listen to any information that does not pertain to the issues. But sometimes there are nondivorce issues that need to be hashed out to successfully resolve a dispute.
- Better for children: Children are never brought into a mediation. Furthermore, when a dispute is resolved in mediation amicably, this can further protect the child from any more stress than necessary.
